CITY OF LYNN HAVEN CODE ENFORCEMENT BOARD

January 19, 2006 -7:00 P.M.

The Lynn Haven Code Enforcement Board held a regular meeting on Thursday, January 19, 2006 at 7:00 p.m. at City Hall.

Sharon Sheffield called the Code Enforcement meeting to order at 7:03 p.m. Ms. Sheffield gave the invocation. The Pledge of Allegiance followed.

Claude Mixdorf made a motion to approve the minutes from the October 20, 2005, meeting. Second to motion John McCrory, motion passed.

Item #5. Case #2005031498. Hearing on Parcel Number 10499-010-000, property owner Ishman Davis.

Mr. Pauga noted Ishman Davis, property owner was not present, but he had received an E-mail from Mr. Davis outlining his plan to bring the property into compliance.

John Pauga presented a Power point overview outlining the violations, noted as M.O. 26-30 sections a, b & c, M.O. 26-32 sections 1, 2, 11 & 12 (a & b), M.O. 26-33 sections 1 & 3 and M.O. 26-97.

John Pauga recommended giving Mr. Davis thirty (30) days from date of order to repair the shed per state code or demolish it and to remove all the trash from the property, place it by the roadway and make arrangements with Public Works for a pick up. If the property has not been brought into compliance at the end of the thirty (30) day period, a fine in the amount of Twenty-five dollars ($25.00) a day would be imposed. If the violation remains on the property sixty (60) days from the date of the Order, the City or its designee will undertake the removal and abatement of any nuisance remaining upon the property in violation of City code, and assess the costs of such removal and abatement against the owner of the property.

Mr. Mixdorf made a motion to give Mr. Davis fifteen (15) days from the date of the Order to abate all nuisances that exist on the property. If the property has not been brought into compliance at the end of the fifteen (15) days then the City or its designee will undertake the removal and abatement of any nuisance remaining on the property in violation of City Code, and assess the costs of such removal and abatement against the owner of the property.

Item #6. Case # 2005071344. Hearing on 1310 Minnesota Avenue, property owner Vincent & Laqueena Anderson.

John Pauga noted the heir to the estate, Diana Amerson, was not present. Mr. Pauga noted David Nash of 703 Mississippi Avenue, who is in the process of purchasing the property was present.

Amy Ross swore in both Mr. John Pauga and Mr. David Nash.

Mr. Pauga presented a Power point overview outlining the Violations noted as M.O. 26-32 section 2 and M.O. 26-33 sections 2 & 4.

Mr. Pauga recommended giving Ms. Amerson seven (7) days from the date of the Order to cut the grass and abate all other violations. If the violations are not cleared at the end if the seven (7) days, then the City or its designee would undertake the abatement of any nuisance remaining on the property in violation of City Code and assess the costs of such removal and abatement against the owner of the property.

Mr. Nash advised the Board he is in the process of purchasing the property, but there has been a delay in the title search. Mr. Nash advised he was willing to undertake the steps necessary to bring this property into compliance. Mr. Nash advised he would cut the grass tomorrow.

Mr. McCrory made a motion to follow staff recommendation.

Item #7. Case # 2005111151 Hearing on 1317 Indiana Avenue, property owner Vincent & Laqueena Anderson.

Item # 8. Case #2005063099. Hearing on 804 Tennessee Avenue, property owner, Daniel & Margo Eudaley.

John Pauga advised the property has been brought into compliance. This case is closed.

Item # 9. Update on 403 Montana Avenue, property owner, Ryan Sandlin.

John Pauga advised that at the April 21, 2005 Code Enforcement Meeting Mr. Ryan Sandlin requested the Board to reduce the amount of the fine imposed on the property at which time the Board agreed to cap Mr. Sandlin's fine at $2,500.00. As of today Mr. Sandlin has not made a payment. Mr. Pauga asked the Board how they wished to handle the collection of the fines. The Board directed the City Attorney, Amy Ross, to impose a lien, plus interest on the property.

Item # 10. Update on 1514 Indiana Avenue, property owner, Mussaratt Buttar.

Mr. Pauga advised that as of December 29, 2005 the house had not been brought into compliance per the Order issued by the Board March 30, 2005. Mr. Pauga requested that this case be brought back before the next Code Board Meeting. Board members agreed.

Item #11. Staff and Board Discussion.

John Pauga gave an update on 1018 Indiana Avenue. The property is in compliance. Case closed.

John Pauga gave an update on Parcel Number 10499-100-000. The property is in compliance. Case closed.

John Pauga reported on the Code Enforcement productivity from 10-21-2005 - 01-19-2006.

There being no further business, the Board adjourned at 8:30 p.m.
