SPECIAL MEETING

February 23, 2006 - 7:00 p.m.

The Lynn Haven Code Enforcement Board held a special meeting on Thursday, February 23, 2006 at 7:00 p.m. at City Hall.

Sharon Sheffield called the meeting to order at 7:02 p.m. Ms. Sheffield gave the invocation. The Pledge of Allegiance followed.

Item #4 Case #2004071433. Continuation of Hearing on 1514 Indiana Avenue, property owners Mohammed Chaudhry and Mussarat Buttar.

John Pauga noted Mr. Chaudhry and Ms. Buttar were present.

Amy Ross swore in John Pauga.

John Pauga presented a power point overview of all Orders from previous Board Meetings regarding this case.

Amy Ross swore in Emory Pitts, Building Inspector for the City of Lynn Haven. Mr. Pitts advised that as of today a mechanical and drywall inspection had not been done. Mr. Pitts advised he is unable to check the insulation because the sheet rock has been installed, covering the insulation. Mr. Pitts advised the permit previously pulled for the plumbing work has expired. Brown's Plumbing requested that the permit pulled for plumbing be voided. There has been no permit issued for wiring or mechanical work. Mr. Pitts advised the sidewalk against the house is in violation of building code and that this house has several building issues. Mr. Pitts further stated that the sheet rock had to be removed and proper permits be obtained before an inspection could be done.

Amy Ross swore in Mr. Chaudhry and Ms. Buttar.

Ms. Buttar advised that permits had been pulled and that she had been verbally told by the building department that she did not need anything on paper when she requested a faxed copy of her permit for plumbing, which expired on 02-16-05. Ms. Buttar advised she has permits for the plumbing and wiring and that the plumbing and wiring have already passed inspection.

Mr. Chaudhry advised as per the March 2005 Code Enforcement Board Order he was given sixty (60) days to hire contractors and abate the violations. Mr. Chaudhry advised that as of today the house is ninety (90) percent complete. Mr. Chaudhry further stated that he has complied with the Board's Orders and pulled the proper permits and hired contractors to do the work.

Mr. Pitts advised he never denied that permits had been pulled, however, the permits previously pulled have expired. Mr. Pitts advised the issues he has with the house are all inside, which have nothing to do with the code violations outside of the house. Mr. Pitts stated that until the sheet rock is removed he is unable to do the inspection on the insulation.

John Pauga recommended that the Board order a Twenty-five dollar ($25.00) a day fine be immediately imposed for the non-compliance with the Order issued March 25, 2005 by the Board. This fine is to continue until all Code Violations are abated and new permits pulled for the plumbing, electrical and HVAC work. Once all the violations are abated and permits pulled the fines will cease.
