CODE ENFORCEMENT BOARD
August 5, 2004
The Lynn Haven Code Enforcement Board held a regular meeting on
August 5, 2004 at 7:00PM at City Hall.

James Griffin called the Code Enforcement Board meeting to order at
6:57 PM.
The minutes from the May 20, 2004 meeting were approved.
John Colosetti gave an update on the property located at 714 Virginia
Avenue. Mr. Colosetti noted that the Property owner, Ricky Kerr, was
not present. John Colosetti provided slides that were taken of the
property on 08/05/04. Mr. Colosetti noted that the yellow submarine has
been removed, the camper that is being used for storage now has a
current tag. Mr. Colosetti further noted that the grass behind the house is
still overgrown and the refrigeration parts are still on the property. The
area between the privacy fence and Chain-link fence is overgrown in
excess of 12". A pile of debris has been placed on the side of the road on
Virginia Avenue. Mr.Colosetti contacted Public Works, who did not
have a pick up order for the trash. Mr. Colosetti stated that the property
is not still not in compliance.
Charlene Messer spoke regarding Mr. Kerr operating a business out of
his residence. Mrs. Messer advised records showed that Mr. Kerr
placed his occupational license on inactive status in August 2002.
Mrs. Messer further advised that Mr. Kerr has been placing his trash in
front of her mailbox instead of on the 8th Street side of his property. She
advised this practice began after the last Code Enforcement Board
Meeting. Mrs. Messer further advised that her only problem has been
with the overgrown grass. She does not feel that an additional thirty
days will solve the problem. She believes that a fine imposed would
get his attention.
Mrs. Ila Kelly advised that even though the yellow submarine is gone,
there is some large sheets of steel in the yard. She further advised she
still had a problem with the trash and overgrown grass and because of
this there is a problem with large wharf rats which she has seen running
along the fence line.
After Board Discussion James Griffm requested that the City Attorney
draft a letter to Mr. Kerr advising him that because of his failure to
bring his property into compliance, the board will reconvene on
August 19,2004 to determine if the violations continue and to assess
fines for continued non-compliance.
John Colosetti advised we would now have a update on the property
located at 310 E. 6thStreet, property owner Elizabeth Register. Mr.
Colosetti noted that Mrs. Register was not present. John Colosetti
then presented slides taken 08/05/2004 showing the property had
accumulated more debris that is scattered all over the backyard. Mr.
Colosetti stated the original junked auto that was under a blue tarp is still
there, but he has removed the tarp. Mr. Colosetti advised two additional
vehicles have been brought onto the property, a yellow Town
Car and a Jeep Cherokee, both have expired tags (5/11/04).
Mr. Griffin advised.he would also like to have a letter sent to Mr.
Register advising him that because of his failure to bring his property
into compliance, the board will reconvene on August 19,2004 to
determine if the violations continue and to assess fines for continued
non-compliance.
Mr. Hagans spoke about the vehicle under the blue tarp. Mr. Hagans
advised the vehicle was covered due to a wreck. Mr. Hagans stated
the yard has been trashed since he moved into his home in November
oflast year.
John Colosetti gave an update on the property at 1502 Texas Avenue.
Mr. Colosetti reported the cars are gone and the property is cleaned up.
The property is in compliance.
John Pauga advised he would present a case regarding 1013 Mississippi
Avenue, property owner Peter Allen.
Attorney Jackson swore in John Pauga and called for Jennings
Disclosures.
Mr. Pauga advised the violations included overgrown grass in both the
front and back yard, buckets, tools and soda cans lying around in the yard
and an un-licensed blue Honda. Mr. Pauga noted that he has not ben
able to make contact with the property owner and has not received
any response to the numerous attempts to contact him, through a door
hanger, phone calls and written correspondence. It was then noted that
Mr. Allen was present at the meeting.
Attorney Jackson swore in Mr. Allen.
Mr Allen stated he disagrees with the amount of trash Mr. Pauga states
is in his yard and he has cut his grass twice since receiving the door
hanger. Mr. Allen further advised that the vehicle is not a junked vehicle.
Mr Allen spoke about how he works 6-days a week leaving him no time
to work on the car in question.
Mr. Griffin asked Mr. Allen why he did not answer the door hanger left
by John Pauga on 5/27/04. Mr. Allen said he did not know he was supposed
to respond or contact Mr. Pauga. Mr Griffin Asked Mr. Allen if
the car has a current tag.
Mr. Allen stated he works 6-days a week, sometimes later than 5 p.m. and
was not aware he needed to respond to the door hanger. Mr. Allen said
the vehicle did not have a current tag. Mr. Allen asked the Board
members what he needed to do to be in compliance.
David Adams told Mr. Allen he needed to get the vehicle in running
condition, with current tags and insurance.
James Griffin said he would give Mr. Allen 5 days to have the vehicle
tagged.
Mr. Allen requested more time, due to his work schedule.
David Adams made a motion to give Mr. Peter Allen thirty days to bring
the property into compliance. If at that time he has not complied, then a
fme of $25.00 a day be imposed. After discussion, it was determined to
impose a $50.00 a day fine after proof from the Code Enforcement
Officer that the property has not been brought into compliance at the end
of thirty days. James Griffin seconded the motion, motion carried.
Attorney Jackson introduced Amy Ross, who will be working with
Attorney Jackson.
John Colosetti asked that orders be drafted by Cindi and submitted to
the Attorney for approval so that the paperwork could be completed in a
more timely manner.
Attorney Jackson advised he did not have a problem with having the
paperwork done by the Police Department and submitted for approval.
With no further business the meeting was adjourned at 7:55 P.M.
