CODE ENFORCEMENT BOARD
September 9, 2004

The Lynn Haven Code Enforcement Board held a regular meeting on August 5, 2004 at 7:00 PM at City Hall.

James Griffin called the Code Enforcement Board meeting to order at 7:05 PM.

The minutes from the August 19, 2004 meeting were approved.

John Colosetti advised we would have a hearing regarding the property located at 403 Montana Avenue. Mr. Colosetti noted that the property owner Ryan D. Sandlin was not present.

Attorney Jackson swore in John Colosetti and called for Jennings Disclosures.

John Colosetti presented a power point presentation outlining the violations, noted as M.O. 26-26 sections 4, 5, 6, 8, 9, 10, & 11, M.O. 26-32 sections 2, & 12, (a), (b) and 26-33 sections 2, 3, & 4. Mr. Colosetti advised a notice and order was delivered to owner, Ryan D. Sandlin, on 12/30/03, giving him 30 days to secure a demolition permit and 60 days thereafter to demolish the property. On 01/22/04, Mr. Colosetti received a letter from Mr. Sandlin stating he had secured bids to repair the property, also Mr. Sandlin stated he would keep the grass mowed and the property secured. On 01/28/04 the City Attorney sent a letter to Mr. Sandlin acknowledging his willingness to repair the house and gave Mr. Sandlin 30 days to begin the repairs. Mr. Colosetti advised that on 07/3/04 he inspected the property and found it to be in a state of non-compliance. Mr. Colosetti noted that after a check with the building department, he found that no building permit had been issued for this address. A Notice of Violation was sent via Certified Mail on 07-26-04. And as of this date nothing has been done to bring the property into compliance.

After Board Discussion Doug Darnell made a motion to give the property owner thirty (30) days to begin work and if at the end of the thirty (30) days the work has not begun, impose a fine of fifty ($50.00) dollars per day. Motion was seconded by Sharon Sheffield. Claude Mixdorf stated he would like to give the property owner fifteen (15) days to get the permit and start the work or a fifty ($50.00) dollar a day fine would be imposed until such time as the permit is pulled and the work begins. Doug Darnell rescinded his motion, Claude Mixdorf made the motion to give the property owner fifteen (15) days to obtain a permit and begin work. If at the end of the fifteen days the property owner has not complied with the order issued, then a fifty ($50.00) a day fine would be imposed. Motion seconded by Sharon Sheffield, motion carried.

John Colosetti advised we would now have a hearing on the property located at 1514 Indiana Avenue, property owner Musarrat Buttar. Mr. Colosetti noted that Ms. Buttar was present.

Attorney Jackson asked for Jennings disclosures from the board members.

John Colosetti then presented a power point presentation of the noted violations which are noted as M.O. 26-26. Sections 3, 4, 6, 8, 9, 10, &12. M.O. 26-30, sections b & c, and M.O. 26-32 sections 1, 2, & 12 (a) & (b), and M.O. 26-33, sections 2, 3, & 4.

Emory Pitts, Building Official for the City of Lynn Haven stated that there have been no permits pulled for this property since 2001. That permit was for roofing work. There has been work done on the residence without a permit being issued and no inspections being done. Mr. Pitts further advised he could not inspect or approve the house in it's current condition.

Attorney Jackson then swore in Ms. Buttar.

Ms. Buttar advised she was trying to get the house completed, however she had to take care of her elderly parents as well as run the family business. Ms. Buttar asked for additional time to bring the house into compliance.

After board discussion Doug Darnell made a motion to give Ms. Buttar sixty (60) days to have a licensed contractor pull a permit and begin work on the house. Claude Mixdorf seconded the motion. Motion carried. John McCrory abstained from voting as she sold the house in question to Ms. Buttar and is currently doing business with her family. Motion carried.

John Colosetti then advised we would now have a hearing on 402 Illinois Avenue, property owner Ralph Zaiger, who was noted as being present.

Attorney Jackson asked for Jennings Disclosures

Mr. Colosetti presented a power point presentation of the violations on the property which were noted as M.O. 26-30 sections a & b, M.O. 26-32 sections 1, 2 ,11, & 12 (a) & (b), M.O. 26-33, sections 3 & 4. Mr. Colosetti further advised that on 08-18-04 he met with Mr. Zaiger at 402 Illinois Avenue to inspect the property and set a list of what had to be done to be in compliance with city code.

Mr. Jackson swore in Mr. Zaiger

Mr. Zaiger advised he, his wife and his son were all on disability, living on a fixed income and it was difficult to do the necessary work. He also said they had recently obtained custody of their handicapped grandchild and were trying to take care of and support her. He presented a schedule outlining the work to be done along with a time line to finish each task. Mr. Zaiger asked for a forty-five (45) day extension to complete the work and bring his property into compliance.

Claude Mixdorf advised he believed Mr. Zaiger would make a good faith effort to bring the property into compliance and made a motion to give Mr. Zaiger ninety (90) days to do so. Doug Darnell seconded the motion, motion carried.

John Pauga advised he would have a hearing on the property located at 1315-A E. 14th Street, property owner Ed Hathaway who is present.

Attorney Jackson swore in Mr. Pauga and asked for Jennings disclosures.

Mr. Pauga presented a power point presentation outlining the violations, which are M.O. 26-32, sections 7, 12 (b), & 13, M.O. 26-30, M.O. 26-7, sections (b), and 2 (d), and M.O. 106-211.

Attorney Jackson swore in Ed Hathaway.

Ed Hathaway advised he did not realize he was in violation, he was just trying to assist a friend begin a business. He asked to be given until the first of the year to have to equipment removed.

After board discussion, Claude Mixdorf made the motion to give Mr. Hathaway until 01-01-05 to remove the equipment and bring the property into compliance. John McCrory seconded the motion. Motion carried.

John Colosetti advised the property located at 714 Virginia Avenue, Property owner, Ricky Kerr, has been brought into full compliance. The property at 310 E. 6th Street, property owner Richard Register, has made great strides and is vastly improved. Mr. Colosetti requested the board to give Mr. Register additional time to remove the bus.

Sharon Sheffield made a motion to give Mr. Register until 10-15-04 to remove the bus. Claude Mixdorf seconded the motion, motion carried.

There being no further business the meeting was adjourned at 8:52 P.M.
