CODE ENFORCEMENT BOARD

The Lynn Haven Code Enforcement Board held a regular meeting on Thursday, November 18, 2004 at 7:00 p.m at City Hall.

James Griffin Called the Code Enforcement Board meeting to order at 7:00 p.m.
Item #2. Previous Minutes.
The minutes from the October 28, 2004 meeting were approved as corrected.
Item #3. Musarrat Buttar, 1514 Indiana Avenue.
Ms. Buttar advised the board that she has hired a contractor who is doing all the electrical work, but due to Hurricane Ivan she has not hired a contractor for the plumbing. Ms. Buttar requested the board grant her an extension of time to hire a plumbing contractor and pull a permit.
Motion by Claude Mixdrof: To give Ms. Buttar a ninety (90) day extension to her original deadline so that a plumbing contractor can be hired, the permit pulled and work can begin.

Item #4. Hearing on 920 Bradley Circle, property owner Sandra M. Cain.
John Pauga presented a power point overview outlining the violations noted as M.O. 26-32 sections 11, 12 (b) and M.O. 26-97. Mr. Pauga noted the occupant of 920 Bradley Circle, Enoch Massalene was present.
Mr. Massaline advised he has gotten the vehicle tagged and has been putting air into the three deflated tires. Mr. Massaline advised the board members he will replace the three tires in a couple of weeks.
Motion by David Adams: To give Mr Massaline thirty (30) days to either inflate, repair or replace the three tires. If at the end of thirty (30) days the tires are not repaired, then a twenty-five ($25.00) a day fine would be imposed.

Item #5. Hearing on 1416 Minnesota Avenue, property owner Edward A. Chestnut.
John Pauga presented a power point presentation outlining the violations noted as M.O. 26-30, sections a, b & c, M.O. 26-32 sections 1, 11, 12, (a & b), M.O. 26-33 section 1 and M.O. 26.97. Mr. Pauga noted property owners Denise and Edward Chestnut were present.
Denise Chestnut advised one vehicle has been removed. Ms. Chestnut stated she is aware of the violations in her backyard and when time permits she has been working on getting her yard into compliance.
Edward Chestnut advised he did not give the Code Enforcement Officer permission to go onto his property and take photographs. Mr. Chestnut stated the reason he has not removed the scrap metal and appliances from the backyard is because he works until 5:00 p.m. and both metal recycling businesses close at 4:00 p.m. Mr. Chestnut advised he is in the process of putting up a privacy fence, but if given 90 days he could clear up all the violations.
Motion by Claude Mixdrof: To give Mr. Chestnut ninety (90) days under good faith to bring the property into compliance and to meet back with the board at the end of the ninety days.

Item #6. Hearing on 99 Kentucky Avenue, property owner Cayahoga Corporation, James M. Ragen,
John Pauga presented a power point overview outlining the violations noted as M.O. 26-30 sections a, b & c, M.O. 26-32 sections 1, 11, 12 (a & b) and M.O. 26-97. Mr. Pauga noted property owner James Ragan was present.
Mr. Ragen said he has removed four dumpsters of trash from the property. The Chevrolet had been sold, but never picked up. Mr. Ragen advised due to recent knee surgery he can not work on the remaining 5 violations for three weeks, but once he resumes cleaning up he could have all the violations cleared in 45 days.
Motion by John McCrory: To give Mr. Ragen forty-five (45) days to complete the cleaning up of the violations and report back to the board in forty-five (45) days.

Item #7 Hearing on 1507 Pennsylvania Avenue, property owner Charity Johnson.
John Pauga presented a power point overview outlining the violations noted as M.O. 26-30 sections a, b & c, M.O. 26-32 sections 1, 11, 12 (a & b) and M.O. 26-97.Mr. Pauga noted property owner Charity Johnson is deceased.
Attorney Ross Advised the board on what options they had to order the property into compliance. Ms Ross advised the order will need to be sent to the last known address of property owner Charity Johnson and one hand delivered to the property, along with orders sent to Gary and Victor Ramey.
Motion by Claude Mixdrof: to give the owner of the vehicles 15-days to tag or remove all vehicles and another 15-days for all other viloations to be brought into compliance for a total of 30 days. If at the end of 30-days the property is not in compliance, then a twenty-five ($25.00) dollar per day fine would be imposed.

Item # 8 Staff Report.
John Colosetti reported on the Code Enforcements productivity for the past 3-months. Mr.Colosetti requested the board members meet with the City Commissioners either the January 10 or January 24, 2005 at 3:00 p.m. The Board advised they would attend the January 10, 2005 meeting.
There being no further business the meeting was adjourned at 9:10 p.m.
