CITY OF LYNN HAVEN
CITY COMMISSION MEETING MINUTES
MARCH 9, 2004 - 4:00 P.M.

The City Commission held a regularly scheduled meeting on Tuesday, March 9, 2004 at 4:00 p.m. in the Commission Meeting Room at City Hall.

Mayor Kelley called the meeting to order and gave the Invocation. The Pledge of Allegiance followed.

Item #3. Mayor's Report:

Mayor Kelley reported that he attended NWFLC Legislative Day in Tallahassee last week and some of the items discussed were water conservation, code enforcement, annexation and revenue sharing.

Item #5. City Manager's Report:

B. Employee of the Month - Feb. 2004:

Chase Curti, Fire Department, was chosen as the Employee of the Month for February 2004 for his outstanding performance and dedicated service to the City.

C. Absence of City Manager: City Manager Lynch will be out of town Thursday and Friday of this week.

City Manager Lynch stated that the newsletter should be ready to go to the printers next week.

City Manager Lynch encouraged everyone to visit the City’s web page.

Item #8. Discussion and possible action regarding approval of Certificate of Concurrency and Development Order for Shadow Ridge Subdivision:

This development will be located between Minnesota Avenue and HWY 389, south of 26th Street. It is approximately 5.70 acres and will consist of a 12 lot subdivision.

Motion by Commissioner Haynes: To approve as presented.
Second to the motion: Commissioner Barnes.

Ms. Anna Vera Yingling commented on lot size and flooding.

Ms. Barbara Day commented on lot size and permits.

Ms. Charlotte Elsner commented on retention ponds and mosquitos.

Item #9. Discussion and possible action regarding appointment to the Leisure Advisory Board:

Item #10. Discussion and possible action regarding term re-appointment to the Leisure Advisory Board:

Staff requests approval to re-appoint Ulysses Hawkins to the Leisure Services Advisory Board for an additional two (2) year term.

Motion by Commissioner Schad: To accept the recommendation of staff as presented.

Item #11. Discussion of efforts to secure the Fuel Depot property for an FSU Oceanographic Research Center and efforts by others that threaten that outcome:

Commissioner Schad stated that he was concerned with a notice in the paper suggesting the City was involved with obtaining the rail road tracks for a proposed rails to trails venture that would be a part of the Recreation Center. Commissioner Schad further stated that this has not come before the Commission and he would recommend writing a letter to the group urging them not to proceed with this effort at this time due to the fact that it could jeopardize efforts by FSU to secure the fuel depot for an Oceanographic Research Center. Commissioner Schad stated that this does not mean he is against rails to trails.

Motion by Commissioner Schad: To authorize sending a letter to the group initiating rails to trails and urging them not to proceed with their efforts at this time.
Second to the motion: Commissioner Barnes.

Mayor Kelley stated that he supports rails to trails.

Commissioner Haynes stated that he supports FSU in trying to obtain the fuel depot, however, he will only support rails to trails west of HWY 77.

Commissioner Wittkopf stated that she has met with this group several times and the workshop that is being proposed is a visioning process.

Mr. Tom Nolin stated that the railroad goes across his lot, however, he does not support a rails to trails behind his home.

Mr. Larry Wells stated that he is in favor of rails to trails all the way to the fuel depot. He suggested overpasses over HWY 77 for safety.

Mr. Dale Robitaille suggested the fuel depot be made into a City park.

Ms. Barbara Day commented on the grant for the fuel depot.

Item #12. Discussion regarding Amnesty Day issues:

City Manager Lynch stated that FDEP precluded the City from using the Pistol Range for storage, however, he would continue to endeavor to find property that could be used for storage. Mr. Lynch also stated that Bay County will be having Amnesty Day for Bay County citizens every Friday and Saturday during the month of April at Steelfield Landfill. Mr. Lynch stated that he will put this information in the newsletter. The City also has special pick-up available.

Mr. Claude Mixdorf stated that people are dumping items in the alleys and along the roadways.

City Manager Lynch suggested that Mr. Mixdorf call Public Works and they will pick these items up.

Item #13. Public Commentary:

Mr. Sammy Day announced his intention to run for election to the City Commission - Seat 2. He asked that the meeting be aired in its entirety.

Mr. Dale Robitaille commented on the election.

Ms. Anna Vera Yingling commented on drainage.

Ms. Barbara Day commented on the City Manager’s salary and contract.

There was no further business to discuss and the meeting was adjourned at 4:48 p.m.
