CITY OF LYNN HAVEN
BOARD OF APPEALS HEARING
DECEMBER 12, 2005 - 3:00 P.M.
The City Commission sat as Board of Appeals on Monday, December 12, 2005 at 3:00 p.m. in the Commission Meeting Room at City Hall.
Present:
Walter T. Kelley, Mayor
Jimmy H. Hughes, Mayor Pro Tem/Commissioner
Roger P. Schad, Commissioner
Frances Wittkopf, Commissioner
John B. Lynch, City Manager
Robert C. Jackson, City Attorney
Matt Riemer, Police Captain
Mayor Kelley called the hearing to order and stated that this is a continuation of the Board of Appeals Hearing from November 29, 2005.
City Attorney Jackson stated that this is a quasi-judicial hearing under Lynn Haven Code; if any of the Commission has had ex-parte communication with the parties since the last meeting it should be disclosed at this time.
Commissioner Hughes stated that he has had no communications with any of the parties involved.
Commissioner Wittkopf reported that she has had no communications with any of the parties involved.
Commissioner Schad reported that he has had no communications with any of the parties involved.
Mayor Kelley reported that he has not had any other communications with the parties involved.
Mr. Steve Rubin, Representative for Mr. Griffin, stated that Mr. Griffin has agreed to place the home on a 100' x 150' lot and have the additional 50' x 150' as a building site at a later date.
Motion by Commissioner Schad: To deny the application that was proposed with the increase in setbacks and to approve the splitting of the three lots into a 100'x150' and a 50'x150' with the requirement that he meet the Code for all other aspects of both lots.
Second to the motion: Commissioner Hughes.
On Vote:

Wittkopf: aye
Hughes: aye
Kelley: aye Motion passed: 4-0
There was no further business to discuss and the meeting was adjourned at 3:08 p.m.
