CITY OF LYNN HAVEN
BOARD OF APPEALS HEARING
MAY 9, 2006 - 3:00 P.M.
The City Commission sat as Board of Appeals on Tuesday, May 9, 2006 at 3:00 p.m. in the Commission Meeting Room at City Hall.

Charlene V. Messer, Assistant City Manager/Clerk
Robert C. Jackson, City Attorney
Dennis Kiah, Assistant Chief of Police

John B. Lynch, City Manager
Mayor Pro Tem Barnes called the meeting to order.
Harry & Elizabeth Smith variance appeal - 602 New York Avenue.
City Attorney Jackson stated that this is a quasi-judicial hearing under Lynn Haven Code; if any of the Commission has had ex-parte communication with the parties involved it should be disclosed at this time.
Commissioner Schad: No communication.
Commissioner Hughes: No communication.
Commissioner Wittkopf: No communication.
Commissioner Barnes: No communication.
Mr. & Mrs. Harry Smith propose to subdivide their 160' x 135' parcel into two building sites with one being 100' x 135' and the second one being 60' x 135'. This would require a 40' variance. This request was denied by the Board of Adjustments on March 30, 2006.
Letters from Mr. & Mrs. Kenneth Jackson - 616 New York Avenue & Mr. & Mrs. Harvey Yawn - 605 New York Avenue were presented to the Commission objecting to the variance request.
Motion by Commissioner Wittkopf: To deny the request as submitted.
Second to the motion: Commissioner Hughes.
Mrs. Smith stated that her neighborhood had 50' lots and this variance would be consistent with the neighborhood.
On Vote:
Wittkopf: aye
Schad: no
Hughes: aye
Barnes: aye Motion passed: 3-1
There was no further business to discuss and the meeting was adjourned at 3:18 p.m.
