Code Enforcement - Junk/Untagged Motor Vehicles

All motor vehicles in the City are requred to have a proper tag and be in a roadworthy condition.  "Motor Vehicle" is defined as "any vehicle which is self-propelled and designed to travel along the ground and shall include, but not be limited to, automobiles, buses, motorbikes, motorcycles, motorscooters, trucks, tractors, go-carts, golfcarts, campers and trailers".


Sec. 26-32. Prohibited conditions.

 

The following conditions are prohibited in the city and are declared nuisances:

(11)    Unsheltered storage for a period of 30 days or more within the corporate limits of this city, except in licensed junkyards, of old and unused stripped junk and other automobiles not in good and safe operating condition, and of any other vehicles, machinery, implements, or equipment or personal property of any kind which is no longer safely usable for the purposes for which it was manufactured, is hereby declared to be a nuisance and a danger to public health, safety and welfare.


(12)    For the purpose of this article, the term "nuisance" shall also include any condition or use of premises or of building exteriors which is detrimental to the property of others or which causes or tends to cause substantial diminution in the value of other property in the neighborhood in which the premises are located. This includes, but is not limited to, the keeping or depositing on or the scattering over the premises of any of the following:

 

b.   Abandoned, discarded, unused objects or equipment such as automobiles, furniture, stoves, refrigerators, freezers, cans or containers.

 

Sec. 26-97. Parking, storing, leaving prohibited; nuisance declared.

 

No person shall park, store, leave or permit the parking, storing or leaving of any motor vehicle of any kind which is in an abandoned, wrecked, dismantled, inoperative, rusted, junked or partially dismantled condition, whether attended or not, upon any public or private property within the city for a period of time in excess of 14 days. The presence of an abandoned, wrecked, dismantled, inoperative, rusted, junked or partially dismantled vehicle or parts thereof on private or public property is hereby declared a public nuisance which may be abated as such in accordance with the provisions of this division. This section shall not apply to any vehicle enclosed within a building on private property or to any vehicle held in connection with a business enterprise, lawfully licensed by the city and properly operated in the appropriate business zone, pursuant to the zoning laws of the city, or to any motor vehicle in operable condition specifically adapted or designed for operation on drag strips or raceways, or to any motor vehicle retained by the owner for antique or classic car collection purposes, provided such vehicle is either operable or in the process of being restored to operable condition. For the purposes of this section, process of being restored to operable condition shall mean material, mechanical or cosmetic repair performed continuously or without interruption beyond any period in excess of 30 days.
